Box 3211 Houston, TX 77253 RE: Supplier Disagreement Resolution No. SDR16CS-04 Dear Mr. Thomas: This correspondence responds to the submission that you lodged with the Supplier Disagreement Resolution (”SDR”) Official on August 11, 2016. Your submission stated that you made an unsuccessful attempt to respond to Solicitation No. 6HQOIG-15-A-0009 for financial services issued on November 4, 2014 and an unsuccessful attempt to submit an Unsolicited Proposal pursuant to Publication 131. I reviewed your letters dated July 15, 2016 and August 5, 2016, along with the supporting documents you provided. In both of your letters, you noted that you attempted to respond to Solicitation No. 6HQOIG-15-A-0009 but “encountered trouble and problems in completing the work, including cyber security issues.” There is no evidence, however, that you lodged a disagreement with the responsible Contracting Officer. To the extent that your submission was intended to be a supplier disagreement concerning the solicitation process, the applicable regulations require it to have been lodged before the time for receipt of proposals established in the solicitation – i.e., by November 18, 2014. See 39 C.F.R. § 601.107(b). Otherwise, the disagreement is considered untimely. In this case, your disagreement was lodged to this office more than a year after November 18, 2014, and, therefore, it is untimely. In your July 15, 2016 letter, you also allege “problems incurred in an attempt to submit an unsolicited proposal.” This issue is not considered a supplier disagreement for the purposes of the supplier disagreement regulations because it does not relate to the solicitation or award of a contract for the acquisition of property or services. See 39 C.F.R. § 601.107(a)(2). If you are interested in submitting an unsolicited proposal, you may send the proposal to the appropriate Supply Management Portfolio Manager at the address provided in and pursuant to Publication 131.
