444 Exceptions

A site for a vending facility to be operated by the blind need not be provided under one of the following conditions:

  1. The SLA, with the concurrence of the Secretary of Education, determines that the building will not support a blind vendor.
  2. Any limitation on the placement or operation of a vending facility, based on a finding that such placement or operation would adversely affect the interests of the United States Postal Service, shall be fully justified in writing to the Secretary of Education, who shall determine whether such limitation is justified. A determination made by the Secretary of Education pursuant to this provision shall be binding on the Postal Service.
