Publication 52 Revision: Cigarettes, Smokeless Tobacco, and Electronic Nicotine
Delivery Systems

Effective October 21, 2021, the Postal Service™ is revising Publication 52, Hazardous, Restricted, and Perishable Mail (Pub 52), part 47, to incorporate new federal statutory restrictions on mailing electronic nicotine delivery systems (ENDS), including their liquids, parts, components and accessories.

Such items will be subject to the same prohibitions as cigarettes and smokeless tobacco due to the enactment of the Preventing Online Sales of E-Cigarettes to Children Act on December 27, 2020. The Act adds ENDS to the definition of “cigarettes” under the Jenkins Act and prohibits mailing ENDS unless they qualify for an exception.

These changes to Pub 52 will align Postal Service mailing standards with the new federal law by including ENDS and the associated mailability exceptions based on the new federal statute. For more detailed information, refer to the final Federal Register notice, Treatment of E-Cigarettes in the Mail, at federalregister.gov.

Although effective October 21, 2021, the standards will not be published in Pub 52 until a future edition. Pub 52 is available online via Postal Explorer® at pe.usps.com.
