P.S. Docket No. 4/105;

03/01/76

Lussier, Edward F.

POSTAL SERVICE DECISION

An Initial Decision was issued by Administrative Law Judge Rudolf Sobernheim finding that Respondent was engaged in a scheme for obtaining money through the mails by means of false representations and recommending the issuance of a remedial mail stop order under 39 United States Code § 3005. Respondent has filed a brief but timely appeal from the decision in which it disagrees with the testimony of the Complainant's witness and offers "more evidence" in the form of allegations with respect to the reputation of the publication carrying its advertising and a low rate of refund requests accompanied by a letter of testimonial. The matter presented is totally insufficient to affect the result. The record fully supports the Initial Decision and it is hereby affirmed. A remedial order is being issued forthwith.
