FINAL DECISION ON MOTION FOR RECONSIDERATION
UNDER THE DEBT COLLECTION ACT OF 1982

            Petitioner, Benita Elder, filed a letter after receiving the June 8, 2006 Final Decision in this case.  Although she did not label her letter a Motion for Reconsideration, or specifically ask that the decision be reconsidered, the letter is treated as a Motion for Reconsideration, under 39 C.F.R. §961.9. 

            Respondent sought to collect $497.38 from Petitioner's salary to recover a salary overpayment.  The Decision held Petitioner liable for the alleged debt. 

            Petitioner again raises the issue discussed in Findings #3 and #5 of the Final Decision, and restates her position that the Postal Service has taken back an excessive number of leave hours that were credited to her.  As was stated in the Final Decision, this is a legitimate issue that the Postal Service needs to examine, but it is separate from the debt that was the subject of the Debt Collection Act proceeding.  Petitioner has submitted nothing to demonstrate that this leave issue affects the debt that she was found to owe.  The Motion for Reconsideration is denied.

            Petitioner also asks what steps she might take to pursue the issue about the reductions to her leave balance.  It is not our role to give her advice, but it is noted that the payroll supervisor who testified at the hearing stated that this matter is not yet resolved and that she is still examining records to determine whether Petitioner’s leave balance is now correct.
